Notification of Alleged Copyright Infringement

To report a suspected copyright infringement, copyright owners or their authorized agents are requested to send a notification to dmca@dogshotrecord.com. This notification must include all of the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • A detailed description of the copyrighted work claimed to have been infringed.
  • Identification of the material on our website that is claimed to be infringing, with enough detail so that we are capable of locating it.
  • Contact information of the complaining party, including address, telephone number, and, if available, an email address.
  • A statement by the complainant that they have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Procedure After Receipt of Copyright Infringement Notification

Upon receiving a compliant notice of alleged copyright infringement, Dog Shot Record will take the following steps:

  1. Conduct an initial review of the notification to ensure that it contains all the information required under the law. Incomplete notifications may not warrant further action.
  2. If the notification is deemed sufficient, the allegedly infringing content will be removed or access to it will be disabled.
  3. Dog Shot Record will attempt to notify the content provider, member, or user that it has removed or disabled access to the material.
  4. Repeat offenders will have the infringing material removed from the site, and Dog Shot Record may take further steps to terminate their access to the platform.

Counter-Notification Procedures

If you believe that the material you posted was removed or access to it was disabled by mistake or misidentification, you may send a counter-notification to dmca@dogshotrecord.com. This counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which Dog Shot Record may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Dog Shot Record will then proceed to carefully evaluate the counter-notification and, where applicable, restore the content or access to it if it is determined that the material was removed or disabled as a result of a mistake or misidentification.

We prioritize the balance between protecting intellectual property rights and facilitating access to content. Our procedures are crafted to address copyright concerns efficiently and effectively, ensuring that rights holders and users alike are supported.
